Not pre-ticked. The customer must actively agree.
A pre-ticked box is not agreement.
ON MOBILE
Footer links must be tappable and readable. Frequently they are the smallest text on the site.
SEARCH ENGINES
These pages need not rank. There is no harm in them being indexed and no benefit in preventing it.
