The common shortcut and its problems.

WHAT PEOPLE DO

Find a similar business, copy their terms, change the name.

WHY IT FAILS

They describe that business's arrangements, not yours They may commit you to things you do not do They may omit things you need They may be for a different jurisdiction They are someone else's copyright

THE PRACTICAL DANGER

Terms stating a fourteen-day returns window when you offer seven.

You are now bound by what you published.

Terms promising next-day delivery you cannot provide.

THE JURISDICTION PROBLEM

Terms written for another country reference its consumer law, which does not apply to you and may conflict with what does.

WHAT TO DO INSTEAD

Write from your actual arrangements. What do you sell, on what terms, with what delivery and what returns?

Use a template as a structure if you need one, and replace the substance with your own.

FOR ANYTHING SIGNIFICANT

Take proper advice. A lawyer reviewing terms you drafted is far cheaper than one drafting from nothing.
